Terms of Service
1. Who these terms are with
Oda is operated by Odapyn SAS, Résidence du Val, 91120 Palaiseau, France (SIREN 948 444 468) — “we”, “us”. By creating an account or using Oda you agree to these terms. If you are using Oda on behalf of a company, you confirm you are authorised to bind it.
2. What Oda is
Oda drafts and executes business work — social posts, outreach emails, ads, websites and related tasks — using AI. Oda acts only on your approval. Content that Oda drafts is held for your review and is published, sent, or paid for only when you approve that specific action.
Oda is an early product under active development. Features change, and we may modify or discontinue parts of the service.
3. Your account
You must give accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old and legally able to enter a contract.
4. Your content, and who owns the output
You keep ownership of everything you put into Oda. To the extent we can grant it, you own the output Oda produces for you — posts, copy, images, sites — and you are responsible for how you use it.
You grant us the licence needed to operate the service: to store, process, and transmit your content in order to generate drafts and carry out the actions you approve.
AI output requires your judgement. Generated content can be wrong, misleading, or unsuitable, and may unintentionally resemble existing material. You are responsible for reviewing anything before you approve it. That review step is the point of the approval gate.
5. Connected platforms
When you connect a third-party account — Instagram, Google, LinkedIn, an ad platform — you authorise Oda to act on that account for the actions you approve. Your use of those platforms remains governed by their own terms, and you must comply with them.
You are responsible for having the right to publish the content you approve, and for the content itself. A platform may suspend, rate-limit, or remove access to your account for reasons outside our control, and we are not responsible for a platform's decisions about your account.
You can disconnect any integration at any time from within Oda.
6. Acceptable use
You must not use Oda to:
- send spam or unsolicited bulk messages, or breach anti-spam law;
- publish unlawful, deceptive, hateful, or infringing content;
- impersonate a person or organisation, or misrepresent an affiliation;
- break the terms or automation rules of a connected platform;
- attempt to disrupt or gain unauthorised access to the service, or circumvent usage, credit, or approval controls;
- process another person's personal data through Oda without a lawful basis.
We may suspend or terminate an account that breaches this section.
7. Plans, credits, and billing
Oda offers a free tier and paid plans. Paid work consumes credits. Subscriptions renew automatically for the period you selected until you cancel, and payments are processed by Stripe.
Cancelling stops future renewals; it does not retroactively refund the current period. Credits are consumed as work is performed. Where you are a consumer under EU law, your statutory withdrawal rights are unaffected by this section.
Spending on external platforms that you approve — advertising budgets in particular — is billed by that platform, is separate from your Oda plan, and is your responsibility.
8. Availability
We aim to keep Oda available and working, but we do not guarantee uninterrupted or error-free service. We may take the service down for maintenance, and third-party platforms and model providers we depend on can fail or change without notice.
9. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost revenue, or lost data. Our total liability arising from the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
10. Termination
You can stop using Oda and delete your account at any time. We may suspend or terminate your access if you breach these terms or if required by law. On termination we delete your data as described in the Privacy Policy.
11. Changes to these terms
We may update these terms as the product evolves. Material changes will be announced in the app or by email before they take effect, and the effective date above will change. Continuing to use Oda after that means you accept the updated terms.
12. Governing law
These terms are governed by French law, and disputes fall to the competent French courts. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence.
